Our Services are intended for sales professionals, business owners, and team leaders committed to professional growth. Minors and individuals unwilling to engage earnestly are not permitted to use our Services. We reserve the right to deny service at our discretion.

Upon enrollment, you may receive:

  • Online, self-paced training courses
  • Group coaching sessions
  • One-on-one coaching
  • Sales scripts, templates, assessments, and frameworks

All content is proprietary and intended solely for your personal or internal business use.

3. Code of Conduct

You agree to:

  • Attend sessions punctually and prepared
  • Engage respectfully with coaches and participants
  • Maintain confidentiality of shared information
  • Refrain from sharing login credentials or course materials

Violation of these terms may result in removal from the program without refund.

4. Payment Terms

Access to Services requires full upfront payment or adherence to an agreed-upon payment plan. You agree to:

  • Provide valid payment information
  • Ensure timely payment of all fees
  • Accept responsibility for any failed payments or disputes

Nonpayment or chargebacks may result in suspension of Services and potential legal action.

5. Refund Policy

All sales are final. No refunds are provided unless explicitly stated in writing at the time of purchase. If uncertain about the suitability of our Services, please contact us prior to purchasing.

6. Intellectual Property

All materials, including but not limited to training content, tools, videos, and frameworks, are protected by copyright laws. You may not:

  • Copy, reproduce, or distribute content
  • Sell or sublicense our materials
  • Record coaching sessions without written consent

Unauthorized use may result in immediate termination of access and legal action.

7. Disclaimer of Guarantees

We do not guarantee specific outcomes, such as increased income or promotions. Success depends on individual effort and implementation of the provided strategies and tools.

8. Limitation of Liability

Pendulum Sales Training is not liable for any indirect, incidental, or consequential damages arising from your use of the Services. You assume full responsibility for your actions and results.

9. Indemnification

You agree to indemnify and hold harmless Pendulum Sales Training, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to Services at our discretion, without refund, for any violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the Delaware Rapid Arbitration Act (DRAA). The arbitration shall be conducted in Delaware, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Both parties waive any right to a jury trial or to participate in a class action.

We may update these Terms at any time. Continued use of the Services after changes indicates acceptance of the revised Terms.
